These Terms and Conditions (“Terms”) govern your access to and use of the subscription-based software service (“Service”) provided by Specrafter LLC, a California limited liability company (“Specrafter,” “Company,” “we,” “our,” or “us”). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Service.

1. Eligibility

  • The Service is intended primarily for business and commercial use. By using the Service, you represent that you are using it in connection with business activities..

  • You must be at least 18 years of age and legally capable of entering into binding contracts.

  • The Service is available only to users located in the United States.

2. Account Registration

  • To access the Service, you must create an account and subscribe to one of our available plans.

  • You agree to provide accurate and complete business information during registration.

  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Subscription and Billing

  • The Service is offered on a subscription basis and billed according to the selected plan.

  • After the Free Trial, you may upgrade to a paid subscription by providing valid billing information.

  • If you do not upgrade at the end of the trial, your access will be suspended and trial data may be deleted in accordance with our Privacy Policy.

  • Subscriptions automatically renew unless canceled before renewal.

  • By subscribing, you expressly consent to automatic renewal and recurring billing as required under California law.

  • For annual subscription plans, we will send an email reminder at least thirty (30) days prior to renewal, as required by applicable law.

  • You may cancel your subscription at any time by submitting a cancellation ticket through your account dashboard or by emailing support@specrafter.com. Cancellation requests will be processed within a reasonable time and will take effect at the end of the current billing period.

  • Except as required by law, fees are non-refundable. We may, at our sole discretion, issue refunds in cases of billing error or unauthorized charges.

  • We reserve the right to modify plans or pricing with 30 days’ notice.

  • Payments are processed by a third-party payment processor (Stripe). By subscribing, you agree to Stripe’s terms and privacy policy.

  • Applicable taxes may apply.

  • We do not collect or store payment information during the free trial.

  • At the end of the free trial, access to the Service will end unless you choose to subscribe to a paid plan. If you elect to subscribe, you will be required to provide valid payment information, and billing will begin only after you complete the subscription checkout process.

4. Permitted Use

  • You may use the Service solely for your internal business operations, including generating product datasheets and related materials.

  • You may not use the Service for unlawful purposes.

  • Reverse engineering, reselling, sublicensing, or distributing the Service or its software is prohibited.

  • During the free trial, you may use the Service only with demo or sample data. Use of real or production data during the trial may result in immediate termination.

5. Data Collection and Privacy

  • We do not collect personal data from visitors who browse the website without registering.

  • During the free trial, we collect limited business information and trial-related data.

  • You agree not to upload real customer or sensitive data during the free trial.

  • Upon subscription, we collect only necessary business and billing information.

  • We do not sell your data.

  • Data handling practices are governed by our Privacy Policy, which is incorporated by reference.

  • In the event of a conflict regarding data handling, the Privacy Policy controls.

6. Intellectual Property

  • All software, technology, and platform content are owned by the Company or its licensors.

  • You retain ownership of the datasheets and materials you generate.

  • We may use anonymized, aggregated data for analytics and service improvement.

  • You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for internal business purposes only.

7. Artificial Intelligence & OpenAI Usage

  • Certain features of the Service use artificial intelligence (“AI”).

  • Specrafter LLC does not provide AI services directly.

  • You must supply your own OpenAI (or other AI provider) API key to use AI features.

  • You are solely responsible for:

    • All AI usage fees

    • Compliance with the AI provider’s terms

    • Reviewing and validating AI-generated content

  • Specrafter LLC makes no warranties regarding accuracy, legality, or suitability of AI-generated output.

8. Third-Party Integrations (Instagram, Facebook, and Others)

  • The Service may allow integration with third-party platforms such as Instagram and Facebook.

  • You authorize Specrafter to connect using access tokens you provide.

  • Specrafter LLC does not control third-party platforms and is not responsible for:

    • Content published through integrations

    • Account suspension, restriction, or termination by third parties

    • API changes or service interruptions

  • Use of third-party services is entirely at your own risk.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.
WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.

9.1. Service Availability
The Service may be unavailable from time to time due to scheduled maintenance, updates, or circumstances beyond our control. We do not guarantee any specific uptime or availability of the Service. Maintenance windows may occur without prior notice.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES.

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE SIX (6) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless the Company from claims arising from:

  • Your use of the Service

  • Your content

  • Violations of law or third-party rights

  • Use of AI-generated or published content

12. Termination & Suspension

  • We may suspend or terminate your account immediately and without refund for:

    • Abuse

    • Illegal activity

    • Violation of these Terms

  • If payment fails, access may be suspended after notice.

  • After one (1) month of non-payment, your account may be removed and data deleted, subject to the Privacy Policy.

  • Following termination, your data will be retained for thirty (30) days, after which it may be permanently deleted in accordance with our data retention practices.

  • You are responsible for exporting your data before termination.

13. Free Trial Terms

  • Trial duration: Two (2) weeks (14 days)

  • Trial is for evaluation only

  • Use of real or production data is prohibited

  • Trial functionality may differ from paid plans

  • The Service is provided “AS IS” during the trial

  • Trial data is retained for up to 30 days after trial expiration unless converted to a paid subscription.

14. Changes to Terms

We may update these Terms at any time. Continued use after updates constitutes acceptance.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of California.
All disputes shall be resolved exclusively in Los Angeles County, California.
